| dc.description.abstract | Türk Medeni Kanunu’nun 2. maddesinde düzenlenen hakkın kötü-ye kullanılması yasağı genel bir hukuk ilkesi özelliği taşımakta olan ve eski hukuk sistemlerinden itibaren uygulanagelen bir kurumdur. Hakkın kötüye kullanılması yasağı kurumu, dürüstlük kuralına aykırılık oluştu-racak biçimde hakkın ileri sürüldüğü durumlarda özel düzenleme bu-lunmadığı takdirde hakkaniyete dayalı somut olay adaletinin tesis edil-mesine hizmet etmektedir. Bu nedenle hakkın kötüye kullanılması yasağı kurumunun özelliklerinin ve uygulama alanının belirlenmesi büyük önem arz etmektedir. Çalışmamızda, hakkın kötüye kullanılması yasağı ve uygulama alanı doktrindeki görüşler ve yargı içtihatları ışığında ince-leme konusu yapılacaktır. | |
| dc.description.abstract | The prohibition on abuse of rights is general principles found in Article 2 of the Turkish Civil Code and has been applied since the for-mer legal systems. The prohibition on abuse of rights, serves the purpose of establishing the justice of the concrete events based on equity when a contradiction to the rule of good faith where the right to submit is used in cases unless there is special provision Therefore, the prohibition of the abuse of the right of properties of the characteristics and their appli-cation area are of great importance. In our study, the prohibition of the abuse of the rights and their application area will be a research subject in the light of the opinions on doctrine and judicial decisions. | |
