dc.description.abstractTicaret sicilini, ticari işletmelerin, tacirlerin ve ticaret şirketlerinin hukuki öneme sahip bilgi ve belgelerinin kayıt altına alındığı, kamunun bilgilenmesi amacının ve hukuki güvenliğin sağlandığı, aleni nitelikteki resmi sicildir. Tez çalışmamız kapsamında geçmişten günümüze ticaret sicilin hukukumuzdaki gelişimi ve yasal düzenlemeleri incelenmiştir. Ticaret sicilin işleyişi, sicil müdürlüğünün sorumluluğu, tescil işleminin üçüncü kişiler ve ilgililer üzerindeki etkileri ve sicil işlemlerine dair en yenilikçi proje olan MERSİS incelenmiştir. Çalışmamız, yargı kararları ve doktrinde yer alan farklı görüşler çerçevesinde yeniden değerlendirilmiş ve ticaret sicil müessesesinde yer alan eksik hususların tespiti de yapılmıştır.
dc.description.abstractTrade registry is the public registry where legal information and documents of commercial enterprises, traders and commercial companies are recorded, the purpose of informing the public and legal security is provided. Within the scope of our thesis, the development and legal regulations of the trade registry from past to present in our law have been examined. The operation of the trade registry, the responsibility of the registry directorate, the effects of the registration process on third parties and those concerned, and MERSIS, the most innovative project on registry procedures, were examined. Our study was re-evaluated within the framework of judicial decisions and different views in the doctrine, and the deficiencies in the trade registry institution were also determined.
