Özet
Kamu kurumları, vatandaşların temel ihtiyaçlarını karşılamak, toplumsal refahı yükseltmek ve sosyal yaşam alanları oluşturarak daha iyi hizmet sağlamak amacıyla yatırımlar yapmaktadır. Kamu kaynaklarının kısıtlı olması ve toplumsal beklentilerin her geçen gün artmasıyla birlikte kamu kaynaklarının etkin, verimli ve ekonomik kullanılması daha da önem kazanmaktadır. Bu nedenle, bu tez çalışması kamu ihale kanunu kapsamında, peyzaj projeleri açısından işleyiş sürecinin eksiksiz ve kanuna tamamen uygun olarak peyzaj mimarları tarafından hazırlanabilmeleri için bir rehber olarak hazırlanmıştır. Bu tez çalışmasında Kamu ihale Kanununa göre ihalenin açılması ve ihaleye başvurunun gerçekleşmesi sırasındaki ve sonrasındaki işlemler Peyzaj Mimarlığı açısında ele alınmıştır. Tez kapsamında, kamuda ve özel sektörde çalışan Peyzaj Mimarları için, peyzaj projeleri ihalenin ilk aşaması olan ihtiyacın ortaya çıkmasından, sözleşme imzalama aşamasına kadar tüm süreçler detaylı olarak ele alınmış, anlaşmazlıklara mahal vermemek adına dikkat edilmesi gereken hususlar belirtilerek, dosya hazırlama sürecinde ihtiyaç duyulan evraklar örnekleriyle verilmiştir. Bu çalışma, inceleme, analiz etme, değerlendirme ve öneri geliştirme aşamalarından oluşmaktadır. 4734 sayılı Kamu ihale Kanunu kapsamındaki yapım işleri ihalelerin sözleşme imzalanıncaya kadar geçirdiği işleyiş süreci, peyzaj projeleri açısından incelenmiş, analiz edilmiş ve değerlendirilmiştir. Sonuç olarak, peyzaj mimarları açısında tüm bu ihale sisteminde karşılaşılacak sorunlara çözüm önerileri sunulmaya çalışılmıştır. Böylece peyzaj mimarları tarafında kullanılabilecek „Peyzaj Projeleri ihale Süreci Rehberi? oluşturulmuştur
Public institutions make investments to meet the basic needs of their citizens, raise public wealth and provide better service by creating social living spaces. As public sources are getting limited and social expectations rising day by day, effective, productive and economic use of public sources becomes more important. Therefore, this study has been prepared as a guide in order for landscape architects to prepare landscape projects with a complete operational process and in compliance with the act. This study investigates the operations which occur during and after the announcement of a tender and applying to the tender within the Public Procurement Act in terms of Landscape Architecture. As part of the study, all the processes of the landscape projects from the emergence of the need, which is the initial phase of tender, to the final signature phase were examined in detail for Landscape Architects who work in public and private sectors; and necessary documents that are needed during the documentation process were presented as examples by highlighting the crucial aspects to avoid dispute. This study consists of examination, analysis, evaluation, and proposal processes. Construction works within the Public Procurement Act the law no 4734 and operational process of tenders until the contract signing phase have been examined, analyzed and evaluated within the scope of landscape projects. Consequently, we have tried to present solutions to the issues that landscape architects may encounter in the tender system.
