Toplumsal Cinsiyete Duyarlı Ombudsman Avrupa Uygulamaları ve Türkiye İçin Öneriler

Abstract

Halkın avukatlığını üstlenerek, temel insan hak veözgürlükleri hususunda birey ve devlet arasındabir köprü olan ombudsman kurumu Türkiye’de2012 senesinde 6328 sayılı yasa ile kurulmuştur.Bir toplumdaki her bireyin devletten beklentileriaynı olmayacağı gibi devletin uyguladığı kamupolitikaları da her kesimi eşit etkilememektedir. Bukapsamda toplumsal cinsiyet eşitliğinin sağlanmasıhususu kamu kurumları tarafından özel bir dikkatve özenle takip edilmelidir. Çünkü toplumsal cinsiyeteşitliğine duyarlı bir kamu politikası izlenmesitoplumda kadın ve erkek eşitliğin sağlanması bakımındanbilhassa mühimdir. Bu makalede Avrupaeşitlik kurumları ışığında Türkiye’deki ombudsmankurumunun toplumsal cinsiyete duyarlılığının birdeğerlendirmesi yapılmış, kimi öneri ve düşüncelereyer verilmiştir. Uzun vadede toplumun kalıpyargılarında zihinsel dönüşümün sağlanması, kısavadede kurumun çeşitli kanallar aracılığıyla bilinilirliğininartması, her ayrımcılık türüne ayrı denetçilerinbakması ve departmanların oluşturulması bukapsamda öne sürülen tavsiye ve düşüncelerdendir.

Undertaking advocacy of public, Ombudsman Institution of Turkey was founded in 2012 as per the law numbered 6328 in the aim of being a bridge between the individual and the state in terms of fundamental human rights and freedoms. Expectations of each individual in a society are not same; likewise, public policies applied by a state do not affect each class in an equal way. Within this context, the issue of gender equality should be followed by the public institutions with special attention and care. Because monitoring a public policy that is sensitive to gender equality is particularly important in terms of ensuring equality between men and women in society. In this article, an assessment was made on the sensitivity of Ombudsman Institution of Turkey against gender in the light of European equity organizations, and some suggestions and ideas were included in the study. The suggestions and ideas put forward within this context were to provide mental change in social stereotypes in the long term, to increase the recognition of the institution by means of various channels in the short term, to assign different ombudsmen for each type of discrimination and to establish departments accordingly.
