Hakkın Kötüye Kullanılması Yasağı ve Uygulama Alanı

Abstract

Türk Medeni Kanunu’nun 2. maddesinde düzenlenen hakkın kötü-ye kullanılması yasağı genel bir hukuk ilkesi özelliği taşımakta olan ve eski hukuk sistemlerinden itibaren uygulanagelen bir kurumdur. Hakkın kötüye kullanılması yasağı kurumu, dürüstlük kuralına aykırılık oluştu-racak biçimde hakkın ileri sürüldüğü durumlarda özel düzenleme bu-lunmadığı takdirde hakkaniyete dayalı somut olay adaletinin tesis edil-mesine hizmet etmektedir. Bu nedenle hakkın kötüye kullanılması yasağı kurumunun özelliklerinin ve uygulama alanının belirlenmesi büyük önem arz etmektedir. Çalışmamızda, hakkın kötüye kullanılması yasağı ve uygulama alanı doktrindeki görüşler ve yargı içtihatları ışığında ince-leme konusu yapılacaktır.
