Zeyd B. Sâbit’in (Ö. 45/665) Ferâiz Adlı Eseri Ve Ebü’z-Zinâd’ın (Ö. 130/748) Şerhi

Abstract

Kaleme alınan eski hukuk/fıkıh metinlerden biri, Zeyd b. Sâbit’e nisbet edilen Ferâiz adlı eserdir. Pek çok klasik metinde bu esere atıfta bulunulmakta ve Zeyd b. Sâbit’in ferâiz ilmine vukûfiyetinden bahsedilmektedir. Fakat görebildiğimiz kadarıyla fıkıh ilminin tedvin tarihiyle ilgilenen pek çok araştırmacı, bu risâlenin günümüze ulaştığından haberdar değildir. Risalenin ehemmiyetine binaen bu çalışmada, Zeyd b. Sâbit’in Ferâiz adlı eserini, çok erken dönemde Ebü’z-Zinâd tarafından yapılan şerhiyle beraber tahkik etmeye çalışacağız. Böylece sahâbe döneminde kaleme alınan ve tâbiîn neslinden olan biri tarafından şerh edilip günümüze ulaşan en eski hukuk metinlerinden birini müstakil şekilde araştırmacıların istifadesine sunmuş olacağız.

One of the old law/fiqh texts is Far?iz which is thought to be written by Zaid ibn Th?bit (d. 45/665). In many classic texts it has been refered to this book and it is mentioned that Zaid ibn Th?bit's expertising on the ilm al far?iz. But our findings show that many of researchers who study on the history of codificaditon of Islamic law have not seen this book. In this study, because of the importance of the book, we publish Zaid's Far?iz and the comments written in very early period by Abu'z-Zinad (d. 130/748) on it. Thus, Ris?la al Far?iz, one of the oldest fiqh texts written in the period of the Sah?ba and expounded in the period of the T?bi?n, will be present to the interest of researchers.
