Türkiye’de Merkezi Yönetim Ve Yerel Yönetim İlişkisinde Sosyal Politikalar Üzerine Karşılaştırmalı Bir Değerlendirme: Kadıköy Belediyesi Ve Esenler Belediyesi Örneği

Abstract

Sosyal politika, ulus devlet ölçeğinde ortaya çıkmış AB merkezli bir kavramdır. Bu kavram farklı sosyal ve siyasal güçler arasında mücadelelere konu olmuştur. Önceleri merkezi yönetimin eliyle yürütülen sosyal politika uygulamalarından çok büyük bir kesimi günümüzde yerel yönetimler eliyle yürütülmeye başlanmıştır. 1990’lardan önce mali kaynakların kısıtlı ve yetersiz olmasından dolayı sosyal politika alanında yerel yönetimlerin faaliyetleri geri planda kalmıştır. 1990’lı yıllardan itibaren özellikle büyük kentlerde büyükşehir belediyelerinin elde ettiği deneyim ve başarılar ve 2005 yılında yürürlüğe giren 5393 sayılı Belediye Kanunu ile 5216 sayılı Büyükşehir Belediyesi Kanunu yerel yönetimlere sosyal politika alanında geniş bir hareket alanı sağlamıştır. Yerel yönetimler halka en yakın yönetim birimleri olarak, halkın ihtiyaçlarını en iyi bilen ve ona en hızlı ve verimli şekilde cevap verebilen kurumlardır. Bu nedenle yerel yönetimlerin uyguladıkları sosyal politikalar önem taşımaktadır. Bu çalışmanın amacı, merkezi yönetim ve yerel yönetim arasındaki idari vesayet ve yerel özerklik ilişkisini yerel yönetimlerin sosyal politika uygulamaları üzerinden incelemektir. Sosyal politika uygulamalarında merkezi yönetim ve yerel yönetim ilişkisini değerlendirebilmek için örnek alan olarak İstanbul’un iki ilçesi seçilmiştir. Bunlar Kadıköy Belediyesi ve Esenler Belediyesi’dir. Bu iki belediyenin seçilmesinin nedeni, iki ilçenin siyasi, sosyo ekonomik ve kültürel açıdan farklılık göstermesi ve yerelin bu farklı ihtiyaçlarına yerel yönetimlerin sosyal politika uygulamaları ile nasıl cevap verdiği Kadıköy ve Esenler Belediyesi üzerinden incelemektir. İki belediyenin hem Sosyal Yardım İşleri Müdürleri ile derinlemesine mülakat yapılacak hem de belediyelerin web siteleri incelenerek elde edilen veriler üzerinden karşılaştırmalı bir analiz yapılacaktır. Bu çalışmada merkezi yönetim ve yerel yönetim kavramlarına açıklık getirilerek, merkezi yönetimle yerel yönetim ilişkisi ele alınacaktır. Sosyal politika kavramı ve hedeflerinden bahsedilecek, aynı zamanda yerel yönetimlerin uyguladığı sosyal politikalara açıklık getirilecektir. Yerel yönetimleri düzenleyen 5393 sayılı Belediye Kanunu ve 5216 sayılı Büyükşehir Belediye Kanunu’nda yer alan yerel yönetimlerin uygulayacağı sosyal politikalara değinilecek ve merkezi yönetimin yerel yönetim üzerindeki vesayeti tartışılacaktır. Yerel yönetimlerin merkezi yönetimle paylaştıkları sosyal politika uygulamalarında, yerel yönetimlerin özerkliği, idari vesayetin sınırları tartışılacaktır. Çalışmanın son bölümünde ise merkezi yönetim ve yerel yönetim ilişkisi seçilen iki belediye yönetimi örneğinin sosyal politika uygulamaları ile değerlendirilecektir.

Social policy is an EU-centered concept emerging at the national state level. A large part of the social policy implementation, which was carried out by the central government in the beginning, has now started to be carried out by the local administrations. Prior to the 1990s, the activities of local governments in the field of social policy had remained on the ground because of limited and inadequate financial resources. The experiences and achievements of the metropolitan municipalities, particularly in the big cities since the 1990s, and the Municipality Law No. 5393 and the Metropolitan Municipality Law No. 5216, which took effect in 2005, provided a wide range of action for local governments in the field of social policy. Local governments, as the closest management units to the public, are the institutions that know the needs of the people best and can respond to them in the fastest and most efficient way. For this reason, the social policies implemented by the local governments are significant. The purpose of this study is to examine the relationship between administrative tutelage and local autonomy between central government and local government through the social policy implementations of local governments. In order to evaluate the relationship between central government and local government in social policy applications, two cities of Istanbul were chosen as an example. These are Kadıköy Municipality and Esenler Municipality. The reason for the election of these two municipalities is that the two provinces differ politically, socioeconomically and culturally. In addition, how the local administrations respond to these different needs through social policy applications through Kadıköy and Esenler Municipality will be examined. An in-depth interview will be held with the "Social Aid Affairs Managers" of two municipalities. On the other hand, a comparative analysis will be made on the data obtained by examining the web sites of the municipalities. In this study, the concept of central government and local government will be clarified and the relation between central government and local government will be discussed. The concept and objectives of social policy will be mentioned and at the same time the social policy applied by local governments will be clarified. Municipality Law No. 5393, which regulates local administrations, and social policies, which local governments will apply in Law No. 5216 on Metropolitan Municipality will be mentioned. The central government's tutelage over the local government will be discussed. The autonomy of local governments and the limits of administrative tutelage will be discussed in the social policy implementations shared by the local administrations with the central government. In the last part of the study, social policy implementations of the two municipal governments selected as the central government and local government relations will be evaluated.
