6098 Sayılı Türk Borçlar Kanunu'nda Tehlike Sorumluluğu

Abstract

Tehlike sorumluluğu, genel bir hüküm ile ilk kez 6098 sayılı Türk Borçlar Kanunu'nda düzenlenmiştir. Tehlike sorumluluğu en ağır kusursuz sorumluluk türünü teşkil etmektedir. Bu sorumluluk türü, sanayi ve teknolojideki ilerlemeler nedeniyle uygulamada önemini her geçen gün artırmaktadır. Bu olgu ise tehlike sorumluluğunun kavram, koşul, kapsam ve sonuçları üzerinde ciddiyetle durulması gerekliliğine işaret etmektedir. Bu çalışmamızda tehlike sorumluluğunu doktrindeki görüşler ışığında Türk Borçlar Kanunu'nun 71.maddesi bağlamında ele almaya çalışacağız

The liability of danger is regulated for the first time under the Turkish Code of Obligations No. 6098 by a general provision. The liability of danger is the most gravest liability without fault. This type of liability is increasing its importance in practice day by day due to progress in industry and technology. This fact points to the necessity to take seriously the concept, condition, scope and results of the liability of danger. In our study, we will try to explain with the liability of danger in the light of the opinions of the doctrine in the context of Article 71 of the Turkish Code of Obligations
